These terms and conditions apply to all orders placed through the Diamond Skies website, operated by Pete Collins trading as Diamond Skies. Please read them carefully before placing an order. By using this website and placing an order, you agree to be bound by these terms.

1. About our products

Diamond Skies sells fine art nightscape and astrophotography prints and cards. Many items are produced to order once your purchase is confirmed. Product descriptions, sizes, materials, and finishes are shown on each product page. Colours may vary slightly between the image on screen and the final print due to differences in monitor calibration and printing materials.

2. Placing an order

When you place an order, you will receive an order confirmation email confirming that we have received your order. This does not mean that your order has been accepted. We reserve the right to refuse or cancel an order for any reason, including but not limited to stock or production limitations, errors in product descriptions or pricing, or suspected fraud.

A contract is formed only when payment has been successfully processed and the order is approved for production or dispatch.

3. Pricing and payment

All prices shown on the website are in British Pounds Sterling (GBP) and include any applicable UK VAT where required. Prices are subject to change without notice, but changes will not affect orders that have already been accepted.

Payment is processed securely via Stripe. We do not store your full payment card details. You confirm that the payment details you provide are your own and that you are authorised to use them.

4. Bespoke and made-to-order items

Because many prints and cards are produced to order, they are made to your specification. Under UK Consumer Contracts Regulations, your right to cancel an order for a bespoke or made-to-order item may end once production has begun. If you wish to cancel or change an order, please contact us as soon as possible at pete@diamond-skies.co.uk. We will do our best to accommodate changes before production starts.

5. Delivery and shipping

We aim to dispatch orders within the timeframe stated on the product page or during checkout. Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by postal or courier services, customs, or events outside our reasonable control.

Risk in the goods passes to you on delivery. Please ensure the delivery address you provide is accurate and complete. We may be unable to redirect a parcel once it has been dispatched.

6. Cancellation and returns

If you are a consumer based in the UK, you generally have the right to cancel a contract for goods purchased online within 14 days of receiving them. However, this right does not apply to bespoke or made-to-order items once production has started, or to items that have been personalised for you.

If you have a change of heart about a non-bespoke item, please contact us within 14 days of receipt to discuss a return. Items must be returned unused, in their original condition and packaging, at your own cost unless faulty.

7. Faulty or damaged items

We take great care in producing and packaging every print. If your order arrives damaged or defective, please contact us within 3 days of delivery at pete@diamond-skies.co.uk with a clear photograph of the damage and your order details. We will offer you the choice of a replacement or a refund for the affected item.

In the case of a replacement, you may need to return the damaged item to us. We will cover the reasonable cost of return postage for faulty or damaged goods.

8. Intellectual property

All photographs, designs, text, and other content on this website are the property of Pete Collins and are protected by copyright and other intellectual property laws. Purchase of a print or card does not transfer any copyright, reproduction, or commercial-use rights to you. You may not reproduce, distribute, or exploit the images in any way without prior written permission.

9. Website use

You agree to use this website only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of the website. We reserve the right to suspend or restrict access to the website if we believe you are in breach of these terms.

10. Limitation of liability

To the extent permitted by law, our liability for any claim arising from the purchase of goods or use of this website is limited to the purchase price of the goods in question. We do not exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

11. Governing law

These terms and any contract formed through this website are governed by the laws of England and Wales, and any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to these terms

We may update these terms from time to time. The version in force at the time you place your order will apply to that order.
